Maritime security & claiming seafarers earnings deductions

Hey Guys, thought I would just let you know that last November we had the team from HMRC Marine section down, to get a few things straight on the old maritime security front.
Here are some points for you:-

SED is NOT available to Non UK Resident or Self Employed seafarers.

All the following criteria has to be met to qualify

1. Must be a seafarer working onboard a SHIP (see EIM 33104 et seq on HMRC site)
2. Each Claim/QP (qualifying period) must run for a minimum of 365 days, starting and ending with a period outside the UK. If QP runs successfully, then this can "roll on" to following years until the claim fails or your employment changes.
3. HS205 should be completed to calculate QP (Help Sheet 205)
4. During each 365 period, at least 183 days must be out of the UK.
5. There must be at least one foreign port visit for each employment in each yax year.
6. 50% rule in HS205 calculation. Bascially the IN days should not exceed the OUT days or the QP will fail and then has to restart at the next OUT date.
7. Days int he UK should not exceed 183 or claim will fail .
8. If 100% SED then personal allowances can be used and be available for other income, ie mil pension or on property let.

You have to complete a full year,(not tax year april to april) but full year from the first time you go OUT of the UK.

A lot of the maritime contracts on gun boats at the moment, are giving the guys freelance contracts, this means your technically self employed, so therefore not able to claim SED, again a number of guys have non residency status then (excuse the pun) jump ship from CP work in Afghan/Iraq to go on the boats, again can't claim SED until we stop your non residency claim.

We have located a company in Jersey GSW Marine Services, that are taking on guys and giving them an employment contract, totally above board and this then takes away the self employment element of it, so therefore SED can be claimed, it does come at a cost though of 3.25% of every invoice you are paid, however if you look at our tax rates, this is a damn sight less than if you would have to pay tax in the UK, and again most companies ie PVI are freelance contracts, therefore your self employed.

There is also another company called MSOL again in Jersey these guys are charging £250, to check you can have SED, then you travel to Jersey to sign a contract, and they are currently taking 4. something percent off every invoice you are paid, along with (as MSOL Jersey are part of the Exeter based accountants) adding on their accountancy charges along with other submission of return charges not sure what their accountancy charges are but all in all still cheaper than the tax you would pay.

Our fees for maritime are £250 per annum, we have direct access to HMRC Marine section and meet with them every quarter for updates on SED.
We also have checked out GSW Marine Services who should be launching in the next couple of weeks, and will recommend these to guys as they only charge 3.25% on each invoice your paid , no other charges added from what I can see, but will keep everyone updated.

Whats you advice on GMRS employment contracts as they only take 2% per invoice, as they as safe as the two companies you have mentioned? many thanks
