Ive have a mate who is doing this through his accountant and havent had time to clarify with any other accountants yet.

Basically instead of claiming SED and being employed by companies such EC, GMRS who will employ you and then charge a percentage of each invoice, he is setting up as self employed and as long as he spends more than 6 months out of uk in a year then he is exempt from paying tax.

This effectivly negates the need to use such companies to employ you and claim SED.

this seems abit hard to beleive for me seen as to be non dom you have to do at least 9 months out the UK, so why have this 6 month rule if self employed?

is anyone else doing this? or can shed any light if this is even above board to do?

thanks in advance.

Are you sure he isn't setting up a limited company and employing himself through that company? Thus getting himself a "employed" status and then claiming SED?

(I'd avoid this route anyway.)

Otherwise I've never heard of what your saying...You need to speak to a specialist in Maritime accountancy, not just any old accountant as it's a very new area. Try CC Associates, Royce tax solutions, and/or whitakers.

If he is self-employed he cannot claim SED, nor can he claim Non-residency as he is not spending enough time out of the UK.

As Leontopodium said he could be doing it as a Limited Company.

If he was doing it as a limited company wouldn't his company have to pay tax and national insurance contributions for any employees?

Whitakers are saying that asking as you spend 6 months outside the uk then you can claim SED as long as one period of time is spent employed on a merchant vessel. So your holidays to Spain, weekends to Dublin and day trips to the IOM all apparently count.
