Fare Evasion Conviction and SIA

Hi guys!

I am recently charged with fare evasion by TFL. I have received Single Procedural Justice notice and I have already pleaded guilty, most probably court will ask me to pay fine. My question after fine. Do I need to notify SIA about it? Because TFL treat fare evasion as criminal offence. Will SIA revoke my licence?

LeoAsad,

Fare evasion is a criminal offence,
TFL can’t just “treat” it as a criminal offence.

Yes, You should report it, although you should have paid the fare to travel with TFL and we would not be having a discussion about it now.

The SIA should be told, they will make their decision and you will / should have your license revoked, because of the position you are employed in you should follow the rule of law.

If you don’t report it, it will show up on your next DBS check and then you won’t have any chance of appeal because you will have broken one of the license conditions of holding an SIA license,
If you report it you have the opportunity to put a case forward and submit character references etc.

Hi,
Thank you for your reply. I have thoroughly checked the SIA site and I have checked their criminality indicator where we can see if we are eligible to get licences with criminal convictions but there were no category related to fare evasion.

Secondly I have asked many people and they said that this fare evasion conviction wont show on DBS as it is non recordable offence and SIA normally conducts Basic/Standard DBS checks only.

Based on that if I took a chance to inform SIA about my fare evasion conviction do you think they will revoke my licence based on this minor offence? Do we have any example?

Thanks

Fare evasion is theft.
You have now pleaded guilty, the SIA expect you to disclose a caution never mind a conviction, and you have pleaded guilty so will be convicted.
I believe you should inform the SIA and put forward your mitigation, you should speak to a lawyer as I can not give legal advice.
I can say I would never plead guilty to anything.
