Hi all

As a company who tuck on a self employed security contractor a person to carry out security services on a premises.

Can I claim company losses against his wages/money owed for job done as this person works when he wants but has to get the job covered which said person did not then this resulted me in money been lost and maybe the contract to.

Any help be really appreciated Thanks

I really do not understand what you are trying to ask here..? If you could clarify exactly what you mean then I could help... This guy is either 'Employed' by you or you are 'Contracting' in his expertise and services...

This industry is riddled with a lack of understanding of employment status!!!!!

You either contracted in a self employed operator to do
manned guarding ? or hired in a guard from another company to do a manned guarding task or RST ?
and he in turn either covers the task himself, or gets some one in to cover the task. so sub letting the task as such.
is that right so far.
but for some reason the tasking wasn't covered at one point.
and you were or weren't informed and didn't have a plan B in place.
is that right.
and now your client is unhappy, as you've let him down.
so you won't get paid for the job that wasn't done.
also you may now lose the contract that you didn't fulfill.
is that the problem.
so you need to find who's to blame and recover your losses.
is that the crux of the matter.
or have I got it totally wrong.

Got it in one. Employed a self employed operator to carry out a task to do security then he decided he wasn't going in which is well in his rights as self employed work when you like, but he failed to get cover for him self then in turn didn't inform me either so this job was not covered for my client and in turn they are not happy with the service provided. So we're do I stand on claiming loss of earnings as this may result in my company loosing this contract. Can i deduct this from money owed to this said person.
