Early termination From the forces ?

I hope this is the right place to post this, but was seeing if anybody knows/ heard of being able to leave the military within a month or two after handing in you notice?

Heard this from several different people that there is a loop hole where you can get a solicitor to apply for you to leave within a month or so, something to do with your employer not being able to hold on to you for 12 months ? Can anybody shed any light on this , or have heard of something similar ?

This is a rumour that has done the rounds for years, I can recall being disatisfied and some bright spark telling me "you only have to give notice based on how often you're paid". Well, not quite.

The statutory notice period for employment is one week BUT this only applies if no other terms are in place. Your notice period is the one to which you agreed when you took the shilling (as it were) and signed your terms of service / contract of employment. The same applies in civvy street, many employers of professionaly qualified people have three - six month notice periods. In some UK colleges the notice period is on month per year of service.

Your best bet is to seek independant legal advice but, to save yourself a lot of expense, many of your questions can be answered by visiting the ACAS website. Remember though, this is a civvy site for civvy employees and may not take into account the nuances of the Armed Forces Act or military terms of service.

If I were you, I would be having this chat with my OC/SNCO directly (although stand by for some remedial training/PT).
 
You can apply for early release (via JPA) and submit a letter via your CO from your future employer, explaining that you may lose the job if they don't let you out in a reasonable time. If they don't accept that then you can appeal.

The one month thing is a load of crap as I tried it and got told to Foxtrot Oscar - as all they have to say is 'due to operational reasons we can't release you any earlier'. They then post / draft you somewhere abroad 'out of sight, out of mind'
 
Oh ok , just thought I would see what the score was. Wasn't to sure if it was " gen" or not. Thank for clearing it up though.
