Conditional Caution and getting my life back

I would love to go abroad but im a single parent, I dont think my kids would relish being taken from their mates!

Thank you, back to the drawing board, I will concentrate my efforts on getting rid of the caution which might open up a few more doors for me and keep looking...
 
Your username makes me wonder if you're feeling a bit down... Maybe just take a step back and see what you want from life, there are so many helpful people on here with so much to offer, chin up, do not accept the caution and I promise you that you will make a friend or two here.

Do not accept the caution under any circumstances. If the Police push the CPS to take it to court go along with your solicitor and fight it. The chances are witnesses may not turn up for such a petty issue and your stance is you were assaulted first and upset by this (this is understandable). Do not let the fact that you resigned from the Specials and your other work cloud the issue. You must try to sort this potential caution out, by getting it dropped. Good luck. Learn the life lesson i.e. your concern for your future kicked in once you had caused this drama, it should have been before.

From what you've said the witnesses are likely to be the doorstaff and attending police officers. both are likely to attend court if called

What exact offence are you been investigated for?

I've never heard of a conditional caution for a minor public order offence. also what are the conditions?

The condition is that I apologise. Which is a kick in the teeth really as I offered to apologise immediatelyand was told by my police bosses not to! It would have meant something then

I have researched some figures and I found that only 4 conditional cautions were given in England and Wales in the last quarter. That's with 18500 PNDs given out for the same offence.

I have instructed a solicitor to help me. I've had to remortgage to pay for it but I am going to really struggle to find work with a caution for public order, especially as it looks like it's much worse because usually that offence would have been NFA or a ticket.

And yes, I am very down. I'm starting to feel a little better now, but what I didn't say in my first post was that following on from being told I was being given a caution, I attempted suicide and spent some time in hospital. I was in total despair at that time but I am feeling a little more positive now.
 
The witnesses are doorstaff and police officers so they will def go to court. Also because I am honest, they have all the evidence thy need to prove me guilty. I don't deny being guilty, I just feel the punishment does not fit the crime. They threw the book at me because I was in the police.
 
Bit of an update.

Theyve lowered it to a simple caution. I still havent accepted it yet.

I now am in full possesion of the CCTV, interview tape and statments. I was set up. The CCTV shows me being hit in the face 4 times and a drink being thrown at me. No sound. I believe that the witnesses (doorstaff) have their own agenda against the police, which was why they have targetted me.

I cant go to court, I cant afford the solicitors bill and I now have anoter job, which I will probably lose if I go to court, regardless of the outcome.

Thankfully I am starting to get stronger now, but my faith in the 'justice system' is now in tatters, as is the confidence I used to have.

Good to hear things are improving for you. As its a criminal case your entitled to free legal aid like everyone else. Also if you were a special were you a paying member of the police federation, if you were you can use their legal team.

You can only be caution if you admit the offence and accept the caution.
 
Hi Mally, Thank you, unfortunately Legal Aid is not available for a Section 5 PO offence and as a Special I wasnt entitled to join the Police Fed! ive learned a lot in hindsight, but that volunteer role I did has almost cost me everything..

I am going to have to accept the caution, I just dont see any other way out without putting my new job at risk. Im already behind on my mortgage payments from losing 2 months pay I cant risk my kids home
 
I may have got that wrong about legal aid, I cant rememember what he said, I wasnt in a great place at the time, but I know im not entitled to legal aid

In your case, my advice is take the caution and move on with your life.

You DO NOT need the stress of going to court.

You WILL NOT have a problem in getting an SIA Licence with a Caution for S5 - Public Order Act.

Simply complete the details on the link and you will see for yourself:-

Criminal Record Indicator

When you get to the second page write Public Order in the box and select from the list.

As you can see you are going to be fine!
