UK & law re expandable batons

I carry a 3 cell maglight and a pair of slash proof gloves in my vehicle since I was threatened by a lorry driver wielding a bowie type knife on the M25 a couple of years ago. Had the circumstances been slightly different he would have been talking to Mr Glock

I would have thought it came under the purpose of use, definition again.
Why would you be wearing these items.
Motorcycle riding for the Kevlar; yes that makes sense.
DS at a swimming pool; well No.
What purpose other than trouble would lead wieghted gloves have ?
Is it reasonable from a public point of view to be wearing these ?
It might be sensible from our point of view, but put yourself in court, defending your decision to wear and use these.
 
yes, you are quite right. As in other aspects of law, a court places a good deal of weight on what a reasonable man/woman might do in a set of circumstances. In traditional media law, the litmus test used to be what "the man on the Clapham omnibus" might think of a given situation! Thanks for your reply.
 
So you can possess at your place of abode a batton and pretty much any other offensive weapon(not classed as a firearm), samurai swords/knives etc. But walk out in to public with them and be caught, then you are in trouble.
Funnily a "colleague", lets call him ..numpty, was half way through training and for some reason decided to keep his Asp in the boot of his car, he was stopped and searched and arrested for carrying an offensive weapon.
Of course being arrested and being charged can be different.

The glove issue has been raised before, if I remember correctly there has been someone convicted for wearing gloves which had lead in the knuckles, I think (altho not certain) that Mersyside Police are quite hot on this and have arrested quite a few people for possesion of a 'branded glove' that advertises weighted knuckles.
I suppose the question is why would you need this item if your norr rididng a bike or conducting rainds in the sand pit......
When it comes to batons I dont think they should be quite so easily available, granted at times I have left my kit in the boot of the car which isnt the best idea.

Indeed i'm sure he did and i'm sure the officers went wisely about their actions, that back light not working, oops is now, guess it's a loose wire, is that cannabis i can smell sir?!
He just looked dodgy (some people do!!) Perhaps his buddy on the training being caught wearing a raincoat police issue that clearly stated it! He was arrested for impersonating a police officer as he had not graduated yet and thought this official overcoat would get him a very well paid security managers job?!!
The scary part is these two banana heads got as far as they did??!!

Although another one trudging up the tube stairs head down and then this cute fluffy little spaniel starts jumping around him wanting to play:)This guys face lit up and i could almost see his thoughts.. "look how cool i am the dog wants to play with me out of all you travellers, the dog likes me:)" He even knelt down and got a good licking, eventually he came down from cloud 9 and realisation hit him as he looked up and saw 4 of us and the dog handler....

It's really controversial, I'd say the idea of "reasonable force" warrants the occasion, I'm not a doorman myself but I can imagine that someone waving a broken bottle at me, an ASP would be an ideal defensive weapon
 
the 3cell is good for in the car or kit bag but as i am a jock and the rain is on all the time up hear i found the steel umbrella when out and about and it is not band yet? :)
 
If you are carrying something in public and it is made or adapted to cause injury to others, it is an offensive weapon. It does not need to be something that is banned. There is no provision in UK law for "defensive weapons". Even if you only use reasonable force an item will be classed as an offensive weapon unless it qualifies as "instant arming" ie. something that you chose to utilise to defend your self that was not designed to be a weapon.

So if you are carrying something that is marketed for self-defence and it is harmful then you are committing an offence.
 
Can You have one if your a sqauddie ?

NO, not unless you are a Service Policeman and it is issued, You do get them issued on tour but they MUSt be handed in before you arrive in the UK.

There is specific legislation and Unit/Station/Camp orders reflect this to make them illegal on Military establishments.

I took mine out with me as I have one all the time (but im allowed), I confiscated quite a few on the way back. Mistakes and forgeting to hand it in is one thing purposely retaining it is 'misapropriation of stores & possession of an offensive weapon'. Please bear in mind if found by either Mil or Civ Police you will wind up arrested, (it's to stop the muppets from beating each other in the block)

Just courious mate , there is a few civvies on ebay that have them . and a few companies online will sell them to only Police / Armed Forces guys . What Regt you in just out of interest ? .
