A: Gun for hire. (usually with a modicum of military training)
Must like prison food, and have eyes in the back of his head.
 
What is a mercenary? Never really found out mate. Was that secret when I was growing up that the Soldier of Fortune Magazines at the news agents where raped in a sealed plastic sleave. Could only see the front and back cover. Come to think of it so was the porn!



Anyone remember Sandline and Tim Spicer? Sir Julius Chan the then Prime Minister of Papua New Guinea got them in to sort the BRA out on Bougainville. International pressure stopped it from going ahead. I think there is still a Hind gunship in a hangar at Port Moresby Airport. I wonder if those guys reinvented them selves?


I think the term mercenary became less common once large wealthy western countries needed the services of ex soldiers, instead of the times when smaller and usually less popular African countries payed or promised to pay them for their trade.

Have worked with few of the guys, nothing wrong with them, and I would work with them anytime.

This is a debate like - " For one man he is a freedomfighter - for another man he is a terrorist ".

A lot of people think Mercenary is something illegal, not necessary, my country has no law that would prohibit one to be a Mercenary.
My activities would dictate if I would be involved in something illegal.

a) Country X would hire me and some of my pals to fight terrorists that are crossing their border. They will pay 20 000$ month.

Do I have a problem with that? NO.

b) Country Z will hire me to put up a Combat Tracking Team in order to track down the insurgents operating in the area. They will pay me 15 000$ month + 200 g of Gold.

Do I have a problem with that. Hell NO!

Do I have any problem with guys that will take gigs like above?
NO.

(a) Is specially recruited locally or abroad in order to fight in an armed conflict;

(b) Is motivated to take part in the hostilities essentially by the desire for private gain and, in fact, is promised, by or on behalf of a party to the conflict, material compensation substantially in excess of that promised or paid to combatants of similar rank and functions in the armed forces of that party;

(c) Is neither a national of a party to the conflict nor a resident of territory controlled by a party to the conflict;

(d) Is not a member of the armed forces of a party to the conflict; and

(e) Has not been sent by a State which is not a party to the conflict on official duty as a member of its armed forces.

2. A mercenary is also any person who, in any other situation:

(a) Is specially recruited locally or abroad for the purpose of participating in a concerted act of violence
aimed at :

(i) Overthrowing a Government or otherwise undermining the constitutional order of a State; or

(ii) Undermining the territorial integrity of a State;

(b) Is motivated to take part therein essentially by the desire for significant private gain and is prompted by the promise or payment of material compensation;

(c) Is neither a national nor a resident of the State against which such an act is directed;

(d) Has not been sent by a State on official duty; and

(e) Is not a member of the armed forces of the State on whose territory the act is undertaken.

Yes, if your home country has laws that prohibit its citizens from working as mercenaries. If you are a citizen of such a country, you could end up serving a long prison sentence after you return home from the op.

Right.
For us without such laws, it is up to each individual to make the call.
 
I would have thought that Prosecution would probably depend on,
if you were paid by and fought for the winning side, or the losing side.

1. Pick your employer carefully - yes, you want to be on the winning side.

2. Conduct yourself at all times in accordance with the Geneva Conventions and other relevant aspects of the International Laws of Armed Conflict. Do not be participate in or be associated with operations or activities that would be war crimes. Otherwise, you could be prosecuted by the International Criminal Court or by your home country.
