James ... It was smart that you spoke to police first and filed the assault charge. If you get documentation on your own injuries, that could help. Take photos and your friend is a witness. I would skip my earlier comments about quietly paying for the window ... This whole thing has gone too far now. Just talk to your barrister about the next steps.

If you are lucky the Prick's ex-GF will also make some kind of statement against him. And possibly he might have a previous record of assaults, in public or domestic. The police will see that stuff and it will point to him as the possible instigator. I cant trll you how this affects your status for work in the UK ... Other people here know that stuff far better than me.

Based very much on what you said in your statements and what you didn't say.
I urge all security operators to seek advice in advance of anything ever happening, and securing the services of a good criminal solicitor as part of your every day protection.
to seek advise after the incident is to go unprepared.
and no excuse.
We see lots of posts on what's the best body armour, whats the best torch, what equipment do I need.
It's all protection of self.
A good solicitor and their number on speed dial is a must.
But a decent training provider would have advised you this, or so I would have thought.

It is lucky for you that "The Attacker" likes to talk to the police, as you did, WITHOUT A SOLICITOR !

Are there any solicitors in the Bath area?? It seems nobody knows the rules of engagment with the old bill where you are.

I hope it all works out for you as I have already said,
IF it does you have had a luck escape and leaned a valuable lesson.

NEVER speak to the police whilst under caution WITHOUT YOUR LAWYER!!!

Hi James,

A lot of good advice given above. I am not here to have a go at you BUT no one, (Magistrate, Police, Solicitor) will consider a simple push would put someone through a window as you describe. That being said, was the person injured and are assault charges being considered? If there is no chance of an assault charge coming your way and I was in your shoes I would bite the bullet, walk into the Estate Agents with a witness, voice recorder running and speak to the person in charge. I would say that I had actually done nothing wrong but wish to resolve the matter ASAP and pay for the window to be repaired. Even if I had to take a loan to cover it.

I don't think you mentioned if CCTV has recorded the incident. Just to add that for a Restorative Resolution, where the injured party and those involved in the damage would be brought together you would have to admit a degree of guilt and that could include reckless as to whether damage was caused by your actions.

I know your stance is that you have done nothing wrong but I would want this sorted ASAP to protect my future in the industry. Think of how much potential earnings you will lose arguing with the SIA over your licence.

does not payment for the broken window indicate guilt.
in your assessment you exclude the falling party being drunk, unsteady and violent.
your suggestion to my mind, contradicts the plea of innocence and self defence.
He needs good legal advice first and foremost and direction from there.
His innocence needs protecting first.
any charges that the police intend to bring need negating and dismissing.
Blame, full blame needs to be placed firmly on his attacker.
to assist this domestic abuse charges need to be applied against the attacker.
if anyone is to deal with the estate agents it should be his legal representative with a view to investigation.
much of the well intentioned advise he has recieved from many on here is misguided, understandable, but sadly wrong in his present circumstances.
The window will or should have been insured, so not a real issue unless the agents try to bring criminal damage proceedings/charges. almost unprovable unless he admits to it (if he hasn't done so already)

We as security operators are employed as experts in our chosen field of operation (meant to be anyway)
leave this to the experts, please ..........

always say nothing till your solicitor or duty solicitor is present... even if you say you want the duty solicitor ..... plod cannot interview you until after you have had legal advice........

See if the confrontation was caught on cctv, or if the estate agent has cctv, then ask politely if you could have a copy of the disc/tape.......... could be plod has already done it....... seen that the other guy was the instigator and decided to charge you with criminal damage....... never accept a caution.... as soon as you do....your license is revoked.......
 
As numerous posters have said seek legal advice ASAP !! Highlights why all security personel should have a sit down with a good criminal law solicitor and have their call out details to hand all the time. The police will very often nick an innocent person and try to get them to take a caution etc just to help their stats! NEVER NEVER NEVER speak to the police without legal council if you have been accused of an offence they ARE NOT YOUR FRIENDS.
 
Hello guys, I'm sorry i haven't been online to keep everyone updated as to what happened and what the outcome was.

First of all i want to say thank you to the CP-World community for every bit of advice they got me, and just helped me through this thing.

Secondly, I can't remember who said it but it's the best bit of advice i have received in a long time which is keep a personal lawyers number in your phone, if it's the company's number or the lawyers personal number have one on hand someone who you can trust, because they can do amazing things.

Anyways the outcome was all charges dropped, Didn't have to pay any insurance excess, didn't get anything, my lawyer spoke a good game and did some amazing things for me while under interview.
