Many thanks Mr Devil very Useful docs and start points for both new entrants and those reviewing their own. One thing I constantly go on about are terms and conditions, these should be carefully put together and in particular can restrict some insurance liability and of course tie in your payment terms, remuneration, cancellation and admin charges and so forth.

One thing I have been told has worked in some sectors is when you invoice to add a late payment charge on the original invoice, therefore invoicing more than the agreed figure but offering a discount for payment within your credit terms to encourage prompt payment. Not sure if this is legal but no doubt Carl will tell me if not ;) but seemed a reasonable idea.

Well CJ quite frankly mate I am not a legal mind... but again if I were to receive an invoice with an enhanced amount with the assumption that I am going to pay late..? then I wouldn't pay it.

A discount should be as it is described, a discount on the original sum agreed, which I agree, can be used to encourage prompt payment.

A little advice for the newcomers to business... If you have dealt with a company or Firm and you are making a demand for money, never address that invoice to an individual within the company or Firm. Address it to the department or the company... trust that this makes sense.

You make some good points CJ with regards to terms and conditions but the most important thing when delaing with debtors is to have an effective debt collection system... from the information on your original Invoice being correct, to Account statements and Final demands.

Saying all that you can avoid trauma in late payments etc by, in the initial stages, working on proforma, conducting some research on the company or by conducting a credit reference check..?

The principle of proforma is good, but what about when you play with the big boys - the government, the councils, the multinationals, and their payment terms are dictated by them if you want the work?

Government and councils are governed by an Act... and they must pay you within 30 days so your risk assessment for non-payment is a minimal risk...

And... nobody dictates your payment terms Bubba... they may decide to pay you late or they may decide to not pay you at all..? but one has nothing to do with the other.
In 24 years, and I have dealt with all sorts of companies nobody has dictated to me my terms. They have paid me late yes and in the Oil industry you can wait 90-120 days for your money.

I'll give you another example Bubba also. There is a guy who has just joined here who is about to leave the Army and has set himself up in Business with a Limited Liability company. Good luck to him I of course wish him well....I can absolutely guarantee you that anyone, not just this guy because I do not know him, but anyone coming to us with that history of a long military career, no business experience, no business credit history and protected by Limited Liability would NOT get a credit facility with RTD Group of small enterprises... I don't care how much they wanted to spend or what they were promising us... the RISK is to great..!
